Terms of Service

Welcome to DocDoctor ("Service"), operated by Phillip Knowles ("we," "us," or "our") and available at docdoctor.info. By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Definitions

• "User," "you," "your" — any individual or entity that accesses or uses the Service.
• "Content" — any file, document, image, or data you upload to or generate through the Service.
• "Output" — the converted files, extracted text, metadata, or other results the Service produces from your Content.
• "Subscription" — a recurring paid plan granting a monthly document-conversion quota.

2. Eligibility

You must be at least 16 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3. Account Registration

Certain features require an account via Amazon Cognito. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use.

4. Service Description

DocDoctor is a cloud-based document-conversion platform. You upload a file, select output formats (Markdown, PDF, JSON, HTML, Excel, plain text, images, metadata, SQL, and others), and receive the converted outputs. Processing is performed by AWS Lambda functions, and files are stored temporarily in Amazon S3.

5. Acceptable Use

You agree not to:

• Upload Content that is illegal, defamatory, obscene, threatening, or that infringes third-party intellectual property rights.
• Use the Service to process files containing malware, viruses, or malicious code.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Circumvent usage quotas, rate limits, or authentication controls.
• Use automated scripts, bots, or scraping tools to interact with the Service without our express written consent.
• Resell, sublicense, or redistribute access to the Service.
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.

6. User Content & Intellectual Property

6.1 Ownership

You retain all ownership rights in your Content. We do not claim any intellectual property rights over the files you upload or the Outputs we generate from them.

6.2 Limited License

By uploading Content, you grant us a limited, non-exclusive, royalty-free license to process, transform, and temporarily store your Content solely for the purpose of providing the Service. This license terminates when your Content is deleted.

6.3 No Training Use

We do not use your Content to train machine-learning models, build datasets, or improve algorithms. Your files are processed and discarded—nothing more.

7. Data Retention & Deletion

• Uploaded files and generated Outputs are stored for 24 hours after processing, then automatically deleted via S3 lifecycle policies and DynamoDB TTL.
• Job metadata (file name, size, timestamps, selected operations) is retained for 7 days for debugging purposes, then deleted.
• We do not create backups of your Content beyond the retention windows described above.

8. Subscriptions, Billing & Refunds

8.1 Free Tier

Unsubscribed users receive 3 free document conversions per calendar month. No credit card is required.

8.2 Paid Plans

Paid subscriptions (Basic, Pro, Enterprise) are billed monthly through Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis until you cancel.

8.3 Cancellation

You may cancel your subscription at any time via the Billing Portal (accessible from the user menu). Cancellation takes effect at the end of the current billing period; no partial-month refunds are issued.

8.4 Refunds

Because the Service delivers digital outputs immediately upon processing, refunds are generally not available once a conversion has been completed. If you experience a Service error that prevents a successful conversion, contact us and we will either re-process your file or issue a credit at our discretion.

8.5 Price Changes

We may change subscription prices with at least 30 days' prior notice. Continued use after a price change constitutes acceptance of the new price.

8.6 Referral Program

DocDoctor offers an optional referral program that allows registered users ("Referrers") to earn commission when they invite new paying subscribers ("Referred Users"). By participating you agree to the following:

• Eligibility. You must have an active DocDoctor account to generate a referral link.
• Commission. Referrers earn 20% of a Referred User's monthly subscription fee for as long as that subscription remains active. Commission accrues monthly and is paid once the cumulative balance reaches $20.00 USD.
• Payout methods. Commission is paid as account credit by default. Referrers may optionally provide a PayPal email address to receive cash payouts instead. Payouts are processed on or around the 1st of each calendar month.
• PayPal email. By saving a PayPal email address you confirm it belongs to an account you own or control. We use this address solely to send PayPal Payouts; we have no ability to withdraw funds from or charge your PayPal account.
• No payout on file. If a payout is due and no PayPal email is on file, we will contact you via your registered email address to arrange payment. Unclaimed commission is held for 90 days, after which it is converted to account credit.
• Prohibited conduct. Self-referrals, fraudulent sign-ups, incentivized clicks that violate third-party platform policies, and any manipulation of referral counts are prohibited and may result in forfeiture of commission and termination of your account.
• Modification or termination. We reserve the right to modify or discontinue the referral program at any time with 30 days' notice. Commission accrued prior to termination will be honoured.

9. Service Availability & Modifications

We strive to maintain high availability but do not guarantee uninterrupted access. The Service is provided on an "as available" basis. We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
• OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless DocDoctor, its operator, and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

12. Third-Party Services

The Service integrates with:

• Amazon Web Services (AWS) — hosting, storage (S3), compute (Lambda), database (DynamoDB), authentication (Cognito), CDN (CloudFront).
• Stripe — payment processing. Your use of Stripe is subject to Stripe's Terms of Service.

We are not responsible for the practices or policies of third-party services.

13. Copyright Policy (DMCA)

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (17 U.S.C. § 512) ("DMCA"). If you believe that content accessible via our Service infringes your copyright, you may submit a takedown notice to our designated DMCA agent.

13.2 Requirements for a Valid Takedown Notice

To be effective under the DMCA, your written notice must include all of the following:

1. A physical or electronic signature of the copyright owner or an authorized agent.
2. Identification of the copyrighted work(s) you claim have been infringed.
3. Identification of the material you claim is infringing, with sufficient detail for us to locate it (e.g., a URL or job ID).
4. Your contact information: name, address, telephone number, and email address.
5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Notices that do not comply with all statutory requirements may not receive a response. Submitting a false or bad-faith notice may expose you to liability under 17 U.S.C. § 512(f).

13.3 Counter-Notice Procedure

If you believe that material you uploaded was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice to our DMCA agent that includes:

1. Your physical or electronic signature.
2. Identification of the material that was removed and its location before removal.
3. A statement under penalty of perjury that you have a good-faith belief that the material was removed by mistake or misidentification.
4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal district court for your judicial district and that you will accept service of process from the complainant.

Upon receipt of a valid counter-notice, we may restore the material within 10–14 business days unless the original complainant seeks a court order.

13.4 Repeat Infringers

We will terminate, in appropriate circumstances, the accounts of users who are repeat copyright infringers.

14. Termination

We may suspend or terminate your account at our sole discretion if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will survive.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in North Carolina. You waive any objection to venue or jurisdiction in such courts.

16. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If a change is material, we will make reasonable efforts to notify registered users (e.g., via email or an in-app banner).

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DocDoctor regarding your use of the Service and supersede all prior agreements.
